1. Acceptance of Terms

By accessing or using SpendScan ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

The Service is operated by Storm Farrell, based in Germany ("we", "us", or "our"). For enquiries, contact us at support@spendscan.app.

2. Description of Service

SpendScan is a receipt scanning and spending analysis service that helps you track and understand your grocery and household spending. The Service uses artificial intelligence to process receipt images and PDFs, extract item data, and generate spending insights.

3. Eligibility and Account Registration

You must be at least 16 years of age to use the Service. By creating an account, you confirm that you meet this requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Please notify us immediately if you suspect unauthorised access to your account.

4. Subscriptions and Payments

SpendScan offers both a free tier and paid subscription plans ("Pro"). By subscribing to a paid plan, you agree to pay the applicable fees as described at the time of purchase.

• Subscriptions are billed on a recurring basis (monthly or annually, depending on your chosen plan) until cancelled.
• Payment processing is handled by Stripe (web) and Apple/Google Play via RevenueCat (mobile). We do not store your payment card details.
• Prices may change. We will notify you of any price changes in advance, and your continued use of the Service after the change takes effect constitutes acceptance.

Right of Withdrawal (EU and UK Consumers)

If you are a consumer in the EU or UK, you have the right to withdraw from a subscription contract within 14 days of purchase without giving any reason ("cooling-off period").

However, by proceeding with a subscription and accessing premium features immediately, you expressly consent to the performance of the contract starting before the end of the 14-day withdrawal period. If you exercise your right of withdrawal after the Service has begun, you acknowledge that you may be charged for the portion of the service already provided.

To exercise your right of withdrawal, contact us at support@spendscan.app within 14 days of your purchase.

5. Cancellation and Refunds

You may cancel your subscription at any time through your account settings, or via the App Store/Google Play for mobile subscriptions. Cancellation takes effect at the end of the current billing period; you will retain access to Pro features until then.

We do not provide refunds for partial billing periods, except where required by applicable consumer protection law or where we have discontinued the Service.

6. Data Privacy

We take your privacy seriously and process your personal data in accordance with the EU General Data Protection Regulation (GDPR), the UK GDPR, and other applicable data protection law. Please read our Privacy Policy carefully — it forms part of these Terms and explains in detail how we collect, use, store, and share your personal data, including information about your rights.

7. User Responsibilities and Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

• Upload content that you do not have the right to share
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Use the Service in a way that could damage, disable, or impair it
• Use automated tools to scrape or extract data from the Service without our permission
• Use the Service in violation of any applicable law or regulation

You are solely responsible for the accuracy and legality of the content you upload.

8. Intellectual Property

The Service, including its design, software, and content (excluding your personal data and uploaded receipts), is the property of Storm Farrell and is protected by intellectual property law. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes in accordance with these Terms.

Your receipt data and the insights derived from it belong to you. We do not claim ownership over the data you provide.

9. Disclaimer and Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose, or uninterrupted availability. AI-generated receipt analysis may contain errors; you should not rely on it for financial, tax, or legal decisions without independent verification.

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.

10. Service Modifications and Termination

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time. Where reasonably practicable, we will provide advance notice of material changes. If we discontinue the Service, we will provide a reasonable notice period and pro-rata refunds for any prepaid subscription fees.

We reserve the right to suspend or terminate your account if you breach these Terms or if your use of the Service poses a risk to us or other users.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Germany. If you are a consumer in the EU or UK, you also benefit from the mandatory consumer protection provisions of the country in which you reside.

We encourage you to contact us at support@spendscan.app to resolve any dispute informally in the first instance. If a dispute cannot be resolved informally:

• EU consumers may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
• UK consumers may contact the relevant alternative dispute resolution scheme or seek recourse through the UK courts.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or via a notice in the Service at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
